Terms of Service

1. Acceptance of terms
By creating an account or using On The Fish ("the service", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the service.
On The Fish is operated by Codaro Pty Ltd (ABN 68 682 118 529, ACN 682 118 529) ("Codaro"), trading as On The Fish. Our website is www.onthefish.app.
2. Your account
You must provide accurate information when signing up and keep your password secure. You are responsible for activity on your account. You must be at least 13 years old (or the minimum age in your country) to use On The Fish. You must be old enough to enter a binding contract in your jurisdiction to purchase a paid subscription.
We may use bot prevention and abuse prevention measures (such as CAPTCHA challenges) to help protect account creation and authentication. See our Privacy Policy for details.
Mobile app (iOS): We offer a native iOS app on the Apple App Store (and TestFlight beta builds) that connects to the same account and service as the website. The app may be offered as a paid download on the App Store (price shown in the App Store at purchase). That one-time App Store purchase is separate from any optional Pro subscription. Pro subscriptions are purchased and managed on the website only; the iOS app does not offer in-app purchase for Pro. If you subscribe on the web, sign in to the app with the same account to use Pro features there.
3. Acceptable use
- Do not upload illegal, harmful, harassing, hateful, or sexually explicit content.
- Do not impersonate others or misrepresent your catches.
- Do not scrape, reverse engineer, or attempt to disrupt the service.
- Do not try to bypass authentication, authorisation, upload limits, AI usage limits, rate limits, moderation controls, or other security measures.
- Do not submit false or abusive content reports.
- Follow all applicable fishing laws, licensing requirements, and catch limits in your area.
- Respect other anglers, private property, and protected species and habitats.
4. Moderation and enforcement
We provide tools for users to report catches and comments that may breach these terms. Reports are reviewed by human moderators or administrators. Submitting a report does not automatically remove content; a moderator decides whether to dismiss the report, hide content, or remove it.
- We may hide or remove content, restrict features, remove group access, delete group media, or suspend accounts that breach these terms or applicable law.
- If your account is suspended, you may be unable to use app features until a moderator restores access.
- Moderators and administrators act in good faith but we do not guarantee a particular response time or outcome for any report.
5. Your content
You retain ownership of the photos, videos, notes, comments, group updates, group media, and other content you post. By posting content, you grant us a worldwide, non exclusive licence to host, display, and process it for the purpose of operating and improving the service (including AI species identification, catch limit lookup, and eating guides). If you enter a competition, you also grant the additional marketing licence in section 8. You are responsible for ensuring you have the right to post any content you upload.
Species descriptions sourced from Wikipedia remain subject to the original licence (CC BY-SA 4.0). Where we display such content, we include attribution and a link to the source article where available.
6. AI and informational features
On The Fish uses AI to identify fish species, generate general catch limit text based on your photo GPS or chosen location, and provide species eating quality guides. These results are provided for general information and guidance only. They may be incomplete, outdated, or inaccurate. Always use your own judgement and verify information with official sources.
- Catch limits: On The Fish is not a legal or regulatory authority. Limits shown in the app are not official rules and do not replace your obligation to comply with current fishing laws, licensing, bag limits, size limits, closed seasons, and protected species rules in your jurisdiction. Regulations change frequently, so confirm with your local fisheries authority before keeping or releasing fish.
- Eating guides: Eating ratings and preparation notes are not food safety, medical, or professional advice. Species misidentification, regional toxins (such as ciguatera), size, season, and preparation method can affect whether fish is safe to eat. When in doubt, do not consume the fish and seek qualified local advice.
- Location: Jurisdiction matching depends on GPS embedded in your photo or a location you select. Incorrect or missing location data may show limits for the wrong area.
7. Groups and sharing
Group features let users create groups, invite members, post group updates, upload group media, comment, and share catches with selected groups. Group admins are responsible for managing group content and membership appropriately. If you share a catch with a group, accepted group members may view that catch according to the sharing settings you choose. Do not add people to groups, post media, or share content in a way that violates another person's privacy, safety, or legal rights.
8. Competitions
On The Fish may run fishing competitions from time to time. Each competition has its own name, schedule, rules, entry limits, and prize description shown in the app. By entering, you agree to those competition-specific rules in addition to these terms.
- Entries: You may submit eligible catches during the entry window. You must confirm that any photo you submit complies with minor-safety requirements. Do not enter photos of identifiable minors unless you have parent or guardian permission for that photo to be used as described in these terms, including for marketing.
- Marketing licence: By entering, you grant Codaro Pty Ltd (trading as On The Fish) a worldwide, non-exclusive, royalty-free licence to use that entry, including photos, videos, captions, and your username or display name, for marketing, advertising, publicity, and other promotional purposes. That includes our website, app, emails, social media, paid ads, press, and other promotional materials, in any media. We will not include GPS or your precise fishing-spot location in that use. If your entry wins, we may also publish a public winner version with GPS/location removed. You will not receive additional payment for this use, other than any prize if you win. This licence applies to every entry you submit, not only winners, and continues after the competition ends, if you later withdraw the entry, or if you delete your account. Withdrawal or deletion does not require us to remove or recall marketing already published.
- Moderation: Competition entries may be reviewed before they appear in voting or results. We may reject, hide, or remove entries that breach these terms, competition rules, or applicable law.
- Voting: Where people's-choice voting is enabled, each user may cast votes according to the competition settings. Vote manipulation, multiple accounts, or abuse may result in disqualification or account action.
- Prizes: Prize details are described in each competition. Prizes are subject to availability, eligibility checks, and any additional terms stated for that competition. We are not responsible for third-party voucher or retailer terms beyond what we publish for the competition.
- Results: Published results may show winning entries and usernames. We may publish location-redacted winner photos as described at entry time.
9. Feedback and support
You may contact us through in-app feedback threads. Keep messages respectful and relevant. Do not use feedback to upload unlawful content or to bypass normal support limits. We may close threads, rate-limit messages, or respond by email or in-app notification. Feedback attachments must be images you have the right to share.
10. Privacy and cookies
Our handling of your personal data is described in our Privacy Policy, which forms part of these terms. Our use of cookies and browser storage is described in our Cookie Policy.
11. Paid plans and billing
Some features are available on a paid Pro subscription. Current pricing, currency, and billing period (for example, per year) are shown on our website and again at checkout before you pay.
- iOS app (App Store purchase): If our iOS app is sold as a paid download on the Apple App Store, that purchase is processed by Apple under Apple's terms. The price shown in the App Store at checkout applies. App Store purchases, refunds, and billing enquiries for the download itself are handled by Apple, not by Stripe or Codaro directly. The App Store purchase grants access to the app; it is not a Pro subscription unless we state otherwise in the App Store listing.
- iOS app (Pro subscription): The native iOS app does not sell Pro subscriptions. Upgrade and manage Pro billing at www.onthefish.app using the same account.
- Payment processing: Payments are processed by Stripe. We do not store your full card number on our servers. By subscribing, you also agree to Stripe's terms where applicable to your payment.
- Automatic renewal: Pro subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. You authorise us (via Stripe) to charge your payment method for each renewal at the then current price, including any applicable taxes.
- Promotion codes: Discount or tracking codes may be offered from time to time, including through the affiliate programme. Each code is subject to its own terms (validity period, eligibility, and whether any discount applies once or on renewal). Affiliate tracking codes do not change the list price. When you use a code at checkout, we record that code so the applicable affiliate can receive commission on eligible web Pro invoices. Affiliates do not receive your full profile or contact details through the affiliate dashboard, only aggregated signup and earnings data. Codes cannot be combined unless we say otherwise.
- Cancelling: You can cancel from your account via Manage subscription (Stripe Customer Portal). Cancellation takes effect at the end of the current paid period unless stated otherwise at checkout. You will keep Pro access until that date.
- Account deletion: Deleting your On The Fish account does not automatically cancel an active subscription. Cancel your subscription first to avoid further charges.
- Price changes: We may change subscription prices. We will give reasonable notice before a price change affects your renewal. If you do not agree, cancel before the next billing date.
- Failed payments: If a renewal payment fails, we may suspend or downgrade Pro access until payment succeeds or the subscription ends.
- Refunds: Except where required by law (including the Australian Consumer Law), subscription fees are not refundable and we do not provide refunds or credits for partial billing periods or unused time after cancellation.
12. Affiliate programme
Paid Pro subscribers may opt in to the affiliate programme from the app after accepting the Affiliate Terms. Affiliates receive a unique tracking code and may earn commission on eligible web Pro invoices from referred customers. Joining does not include Pro access, extra app quotas, or a customer discount. Affiliates must provide accurate contact details, disclose that they may earn a commission, and must not misrepresent the service, spam users, bid on our brand name in paid search, or refer themselves. We may change commission rates, suspend codes, or end participation at any time. Commission is calculated from our records; payouts are by bank transfer subject to the floors in the Affiliate Terms.
13. Rate limits and security controls
We may apply upload limits, AI usage limits, request rate limits, request size limits, bot protection, moderation controls, and other security or abuse-prevention measures. Limits may vary by account type, subscription tier, admin configuration, endpoint, location, IP address, or service availability. We may change these limits to protect the service, manage costs, comply with provider requirements, or prevent abuse.
14. Disclaimers
The service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, free of errors, or that content (including AI output, catch limits, eating guides, weather, or location data) will be accurate, current, or complete. We do not warrant that the service satisfies any legal, regulatory, or food safety requirements in your jurisdiction.
15. Limitation of liability
To the maximum extent permitted by law, Codaro Pty Ltd and its operators shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, profits, or goodwill arising from your use of the service, including any reliance on AI identification, catch limit information, eating guides, or location based jurisdiction matching. Nothing in these terms excludes, restricts, or modifies rights or remedies you may have under the Australian Consumer Law or other mandatory consumer laws that cannot be excluded.
16. Termination
You may delete your account at any time. We may suspend or terminate your access if you breach these terms, if your account is subject to moderation action, or if required by law. On termination, your right to use the service ends immediately, subject to any active subscription period you have already paid for.
17. Changes to these terms
We may update these terms from time to time. Material changes will be highlighted in the app or by email. Continued use of the service after changes take effect constitutes acceptance.
